Having marijuana records expunged can assist with regaining access to financial aide and public assistance programs.

Prop 207 also known as the Smart and Safe Arizona Act, was a ballot measure on the general election ballot on November 3, 2020.

Approved by roughly 60% of the voting population, this proposition enabled adults aged 21 and above to legally use, purchase, and be taxed on recreational cannabis.

Proposition 207 also included a new statute (A.R.S. § 36-2862) that authorizes some people to petition a court for an order that will seal their marijuana-related criminal records. Eligible petitioners are those who were arrested, charged, convicted or acquitted of any of the following offenses based on conduct occurring before November 30, 2020:

-Possessing, consuming, or transporting two and one-half ounces or less of marijuana, of which not more than twelve and one-half grams was in the form of marijuana concentrate;

-Possessing, transporting, cultivating, or processing not more than six marijuana plants at your primary residence for personal use; or

-Possessing, using, or transporting paraphernalia related to the cultivation, manufacture, processing, or consumption of marijuana.

A class 6 undesignated felony, is a type of crime that could potentially be labeled as a misdemeanor.

When someone is found guilty of committing a class 6 undesignated felony, it's treated as a felony while they're on probation. Currently, there are more than 200 offenses in Arizona that fall under the category of class 6 felonies.

When someone's judgment is set aside, it means that a person who was found guilty of a crime gets released from all the punishments and negative effects that came with the guilty verdict.

This is different from having a criminal record erased, which is known as expungement.

Unfortunately, set asides do not erase your conviction and can still show up on the person's record through third party companies, but the penalties that came with it are removed.

Even though the record is still visible to the public, there will be a note saying that the judgment has been set aside on state databases.
